FOR AUCTION Rural building in Castel Sant'Angelo (RI), Cotilia locality, Via Prima Nazionale, State Road 4 Salaria 22-24

This is a early-1900s sky-to-ground small building of a typically rural type, with an almost rectangular plan, inserted in a small "row" of similar buildings facing State Road 4 Salaria, a well-known urban road with lanes for vehicular traffic that connects various areas in the Reatino territory, with which it shares a portion of a common external courtyard that acts as a buffer between the properties and the road.
It has a total residential surface area of 162 sq m.
The building, now uninhabited for about 15 years, is arranged over 2 above-ground levels and has been cadastrally divided into two real estate units, adjacent and in fact communicating with each other.
The portion registered on Sheet 20, parcel 442, sub. 1 is accessed via a wooden door at street number 24 of Via Salaria leading into a small "vestibule" and through a second wooden-and-glass door you enter a large suspended-ceiling room used as kitchen/living room, with a window, from which, through an internal door, you access a hallway where the common staircase starts and leads to the upper floor. From the same hallway you also access the kitchen of the other real estate unit, which uses the same staircase to reach its rooms on the second level. On the first floor there is the sleeping area, consisting of a large bedroom and a small bathroom; in the main room the single-pitch sloping roof is visible, made with a wooden beam structure and terracotta tiles.
The portion registered on Sheet 20, parcel 442, sub. 2 is accessed via a wooden door also bearing street number 24 of Via Salaria and leads into a small vaulted cellar room where a washbasin is present; from a second wooden door at street number 22 you enter a large kitchen/living room with a window and a ceiling with exposed wooden beams, and also featuring a fireplace; through a door you access the hallway where the common staircase is located, leading to the upper floor. Also in this case, on the first floor there is the sleeping area, consisting of a large windowed bedroom with a sloping wooden ceiling and a second small bedroom with a vaulted ceiling like the cellar below. This real estate unit has no sanitary facilities.
The rural property was originally a single real estate unit; the division into two separate units was carried out when the building was entered in the Buildings Cadastre and no authorizing urban-planning file for such division was found at the Municipality.

Cadastral discrepancies are therefore present.

WARNING REGARDING THE PROVENANCE OF THE PROPERTY
Potential bidders are informed that, from the examination of the mortgage and notarial documentation, it emerged that the over-twenty-year provenance of the property derives from possession suitable for adverse possession (usucapione) not supported by a recorded declaratory judgment.
In particular, in the deed of sale executed before Notary Giuseppina Casazza on 6 November 2015, repertory no. 31899, file no. 18865, the predecessors in title of the current owner declared that they had possessed the property continuously, peacefully and uninterruptedly for over twenty years, specifying that no declaratory judgment of adverse possession had been recorded and that the purchaser had acknowledged the related risks.
Interested parties are therefore expressly informed that the transfer of the asset will take place in the factual and legal condition in which it is found and that the subsequent notarial deed of transfer will be executed substantially reporting the same provenance clause contained in the deed of purchase of 6 November 2015, with an explicit reference to the aforesaid legal situation.
Participation in the competitive procedure and submission of the offer imply full knowledge and acceptance of the above circumstance, without this being able to constitute grounds for dispute, price reduction or compensation claim against the Procedure, its bodies or the Trustee.
