Full ownership of a large portion of a building for commercial/office use with appurtenances, forming part of a multifunctional complex located in the Municipality of Crespina Lorenzana (PI) – Hamlet of Cenaia, Località Lavoria, Via Galileo Galilei snc, divided into several lots functional to their respective intended use according to the PIP guidelines with the related implementation plan.
The property portion in question consists of the ground floor of the right-hand part of the block located further to the left of the row building forming part of parcel 539, as well as the first floor and the basement level of the same building.
Access to the various floors is via two stairwells (with provision for a lift) in reinforced concrete located at the north and south ends of the property portion in question. These stairwells are currently closed and not accessible from the ground floor for safety reasons.
On the basement level, which can also be accessed via a ramp on the south side of the building and set within an exclusive courtyard area, there is currently a single large room (also connected with sub 46) but it is intended to be divided into two parts (it lacks the dividing wall).
Permitted use is storage/utility room.
Similarly, the first floor is completely open, without a dividing wall that has not been completed, and without walls also towards building C3/C4 (sub 46).
The bathrooms have not been built.
The property portion in question borders, on the north front, a public-use pedestrian passage (“gallery”), while the east side faces a condominium courtyard area, all represented by sub 1 of map parcel 539.
On the west side, an exclusive courtyard area with driveway access of approximately 180.00 sqm has been identified.
The gross covered area of the property is 375 sqm on the ground floor, 1,146.80 sqm on the first floor, 991 sqm on the basement level (ramp excluded).
Appendix:
Also included in this lot are the following parcels of land used for parking, roadways and green areas, which are part of the completed urbanization works but, having the character of condominium property for public use with access and enjoyment for all condominium owners, may be subject at any time, upon notice, to acquisition by the Municipal Administration.
Specifically:
Land Registry of the Municipality of Crespina Lorenzana, Section “A” Sheet no. 1 parcels no. 529 of 4.00 sqm for a share of 92,727/100,000, no. 530 of 160.00 sqm for a share of 92,727/100,000, no. 534 of 165.00 sqm for a share of 92,727/100,000 and no. 548 of 4,115.00 sqm in full as an urban entity awaiting assignment.
Common property:
The multifunctional complex where the asset for sale is located is governed by condominium regulations that oversee the functionality and management of the entire complex for the use of the various units and common items: the galleries, the internal square with the fountain, all condominium-type roof coverings, all footprint areas also designated as green space, the allocation of expenses, the protection of the appearance and decorum of the Compartment as a whole and, in particular, also the management of any renewable energy systems that could complete the entire complex.
All parts of the complex viewed in its architectural and legal unity, albeit with various intended uses, constitute common parts, namely those indivisible parts and of common interest for the safeguarding, protection, integrity and preservation of the complex. These include:
- the land on which the various condominium buildings stand, the foundations, the load-bearing structure with the roof covering and anything else by destination and use of common interest pursuant to the Italian Civil Code in force;
- all areas of common interest referred to in the deeds of title and in any case of general interest for the functions provided within the Compartment;
- the systems, the discharge networks with the various collection tanks up to the entry of the individual properties;
- the various storage tanks provided in the basement level for the recovery of waste and/or rainwater to be reused in the production cycle or limited to sanitary services only, as these are non-potable waters;
- the main risers for electricity and water, and the networks of common interest up to the entry of the individual properties;
- all private roadways serving the complex, including those in the basement level intended for garage premises;
- the decorum and image of the complex viewed in its architectural unity, even if internally divided into exclusive properties;
Therefore, all roof coverings of the various artisan workshops, which are obviously of a private nature, are to be considered excluded.
Ownership of all common items belongs to all condominium owners in proportion to the value of each unit and according to the thousandths attributed to each asset.
The asset in question contributes to the maintenance of the common parts of the entire complex, specifically the condominium areas, the fire-fighting network, the technical water network, according to the following thousandths share: 64.061‰.
There are no discrepancies compared to what appears in the municipal records except for some tolerable differences in internal measurements which fall within the tolerances under Law no. 105 dated 24/07/2024. Since these are non-essential variations, the discrepancies can be remedied by filing a compliance assessment application pursuant to art. 209 of Regional Law no. 65/2014 and subsequent amendments, with payment of the relevant penalty.
