Full ownership of a large portion of a building for commercial use forming part of a multifunctional complex located in the Municipality of Crespina Lorenzana, Hamlet of Cenaia, Locality Lavoria, Via Galileo Galilei snc, divided into several lots functional to their respective intended use according to the guidelines of the P.I.P. with the related implementing plan.
Access to the property portion in question is from the new planned road called Via Galileo Galilei and from the square via the courtyard (resede) and the gallery shared with other real estate units forming part of the complex (sheet no. 1 parcel 539 sub.1).
This portion is accessed through sub 45 (stairwell and elevator), which in turn from the common corridor on the first floor allows, via a skylight with retractable ladder to be installed, access to the roof level identified as sub. 42 (in this case, passage must be ensured for maintenance of the roof and the flat roof terrace).
It is currently intended for commercial activity on the ground floor, with the possibility for the first floor to be used as office/management space, while the basement level is for the exclusive use as storage/warehouse.
It was built with a prefabricated structure on three levels (basement, ground floor and first floor), connected to each other by a stairwell and elevator located at the south and north corner of the unit in question.
The basement floor (used as a warehouse) and the first floor (commercial premises) currently lack the dividing wall on the south side defining the boundary with the unit identified as sub. 61 (it is necessary to define the position of the dividing wall near the connection joint). The commercial premises on the ground floor have only one unfinished bathroom and the provision for a second toilet. The property faces north and south onto a gallery for public use (parcel 539 sub 1), while the east and west sides face condominium sidewalks and courtyard areas. The gross covered area of the property is 860 sqm on the ground floor, 825 sqm on the first floor and 791 sqm in the basement (ramp excluded), or as effectively resulting.
Common property:
The multifunctional complex where the asset for sale is located is governed by condominium regulations that oversee the functionality and management of the entire complex for the use of the various units, the common areas, the galleries, the internal square with the fountain, all condominium-type roof coverings, all footprint areas also intended as green areas, the allocation of expenses, the protection of the overall appearance of the block as a whole, and in particular also the management of any renewable energy systems that could complete the entire complex.
Common parts include all parts of the complex viewed in its architectural and legal unity, albeit with various intended uses, namely those indivisible parts and of common interest for safeguarding, protection, integrity and preservation of the complex. These include:
- the land on which the various condominium buildings stand, the foundations, the load-bearing structure with the roof covering and anything else by destination and use of common interest pursuant to the current Civil Code;
- all areas of common interest referred to in the deeds of origin and in any case of general interest for the functions envisaged within the block;
- the systems, the drainage networks with the various collection tanks up to the entrance of the individual properties;
- the various tanks provided in the basement for the recovery of wastewater and/or rainwater to be reused in the production cycle or limited to sanitary services only, as these are non-potable waters;
- the riser columns for electricity and water, and the networks of common interest up to the entrance of the individual properties;
- all private roads serving the complex, including those in the basement level intended for garage premises;
- the decor and image of the complex viewed in its architectural unity even if internally divided into exclusive properties;
Therefore, all roof coverings of the various artisan workshops are to be understood as excluded, being obviously of a private nature.
Ownership of all common parts belongs to all condominium owners in proportion to the value of each unit and according to the thousandths allocated to each asset.
The asset in question contributes to the maintenance of the common parts of the entire complex, namely the condominium areas, the fire-fighting network, the technical water network, according to the following thousandths share: 74.766‰.
There are no discrepancies compared to what appears in the municipal records except for some tolerable differences in internal measurements that fall within the tolerances set out in Law no. 105 dated 24/07/2024. As these are non-essential variations, the discrepancies can be remedied by filing an application for a certificate of compliance pursuant to art. 209 of Regional Law no. 65/2014 and subsequent amendments, with payment of the relevant penalty.
