AUCTION BASED ON A RECEIVED OFFER
The complex is located on the edge of the built-up area of Camucia, which is the valley extension of the town of Cortona, along the Umbro-Casentinese Regional Road, and is 5 km from the center of Cortona and about 7 km from the Perugia-Bettolle motorway link road.
It has a total overall surface area of approximately 1,289 sqm.
The building complex consists of a building facing the Regional Road that was built as an exhibition space for cars, and a rear multi-purpose building where the workshops, car spare-parts warehouses and two apartments used by the owners are located; the external yard area is arranged to facilitate the activity of car resale and repair, with the incidental presence of the two dwellings that do not enjoy exclusive spaces. The yard has a wide frontage on the regional road, a side frontage on a rural road, and two frontages bordering properties of third parties; all of this is accompanied by a plot of land located across the regional road where second-hand cars were stored.
The buildings were constructed on land acquired by the partners with various building interventions spanning the period from the second half of the 1970s to the beginning of this century.
The main building was built through a series of interventions from the early 1970s up to the first decades of the 2000s.
The original building body consisted of the dwelling on the first floor and the adjacent workshop.
In the early 1980s the workshop was expanded, continuing construction on the north frontage, and the mezzanine-floor apartment was built, occupying the portion of the workshop beneath the first-floor dwelling.
Below the new apartment a storage room serving the workshop was built which, presumably, was obtained by excavating below the level of the original floor level to a depth of about 80 cm. This latter intervention can be inferred from reading the drawings of the authorizing permits which, however, are inconsistent on the point.
In the expanded part of the workshop an attic was created, accessible from inside the workshop via an iron staircase, by building a horizontal slab in hollow-tile reinforced concrete.
On the rear of the building, through several interventions and without authorizing permits, a substantial extension was built incorporating the paint-baking oven; the structure was made with iron columns and beams and asbestos-cement sheets.
In the early 2000s the extension abutting the main façade was built; it is likely that at the same time as this latter intervention the iron structure was installed in the expanded part of the workshop; the structure led to the creation of a mezzanine which, together with the space below, serves as a spare-parts warehouse.
The first-floor apartment is accessed via an external staircase starting from the yard and consists of a living area comprising a living room and a kitchen-dining room, separated by an entrance hall, and a sleeping area comprising 3 bedrooms, a bathroom serving the whole dwelling and a bathroom for the exclusive use of one bedroom; the sleeping area is separated by a corridor that leads to the entrance of the living area.
The mezzanine-floor apartment is accessed via an external staircase starting from the yard and consists of a living area comprising a living room and a kitchen-dining room, separated by an entrance hall, and a sleeping area comprising 3 bedrooms and 2 bathrooms; the sleeping area is separated by a corridor that leads to the entrance of the living area.
The workshop can be divided into 5 portions, namely the semi-basement warehouse, the mechanical workshop, the mezzanine warehouse, the spare parts retail area and the body shop. The five portions are described separately below. None of the five portions has toilets and changing rooms inside. The only toilet is the one located at the rear of the building, accessible from the boiler room serving the apartments above.
The semi-basement warehouse is located in the area beneath the apartments and is accessed from inside the workshop and from a vehicular door located at the rear of the building that opens onto the yard. The room was built at the same time as the mezzanine-floor apartment, lowering the floor level of the portion of the original workshop located beneath the first-floor apartment. The room is 1.96 meters high and is poorly lit.
The mechanical workshop was intended for mechanical repairs. This portion of the building is the original part covered by the vaulted structure; there is a booth made with panels that served as an office booth, 3 overhead cranes, a compressed-air system and an electrical system with industrial sockets along the entire perimeter; the systems are dated. An iron staircase against the wall leads to the attic room created in the part that constituted the workshop expansion (today a warehouse). The workshop communicates through internal doors with the semi-basement warehouse, the mezzanine warehouse and the body shop.
The mezzanine warehouse is located in the part of the workshop that was expanded in 1980 on the north frontage of the building. Inside the room an iron structure was installed, connected by an iron ladder, which created a usable mezzanine. On both levels of the structure shelving was installed for storing vehicle spare parts. The height of the lower level is 2.25 m, while that of the mezzanine is 1.76 m. The lower level is connected to the mechanical workshop and to the spare parts retail area; from the mezzanine of the warehouse one accesses the mezzanine above the spare parts retail area. Both levels are cramped, due to the narrowness of the paths, and poorly lit.
The spare parts retail area is the most recent part, built in the early 2000s and abutting the main frontage of the building. The structure was made of steel and infilled with sandwich panels and consists of a single room intended for the sale of spare parts. Access is from the yard of the building complex; the sales room is internally connected to the mezzanine warehouse. The mezzanine above the retail area is intended as storage and is accessible from the mezzanine of the adjacent warehouse. The room is organized with a counter and systems functional to sales.
The body shop is a room abutting the east façade of the main building. Access is from the portion of the yard located at the rear of the building; there is also a door on the north frontage that leads to a small portion of yard. Inside the single room there is a bulky and obsolete body-shop baking oven with an exhaust made with asbestos-cement elements.
The most recent building in the company’s building complex is the one intended as a showroom, located along the regional road. The building was built at the end of the 1980s and was constructed with a point-support elevated structure; the two above-ground levels constituted a “display window” for exhibiting cars along the regional road. The first floor is equipped with a reinforced-concrete driveway ramp starting from the yard, allowing cars to reach the first floor. Internal connection is provided by a single-run overlapping staircase connecting the two levels and the roof level where there is an accessory room used as a warehouse. At ground-floor level there are some rooms used as offices, presumably for administration, and a bathroom; there are also some booths made with furnishing panels that were used as an area for vehicle sales.
The roof, unpaved and apparently lacking waterproofing, consists of a recessed terrace with a reinforced-concrete parapet that affords a decent view of the Cortona hillside.
The building complex is equipped with a yard arranged in a functional way for carrying out the activity of car resale and repair. The yard is entirely asphalted or paved in concrete, except for a flowerbed in front of the showroom building and a hedge along the rural road. The fencing along the road frontages consists of a 20–30 cm wall topped with an iron railing and is equipped with a driveway access along the regional road and two driveway accesses along the secondary road; on the other frontages there are buildings or concrete walls, or a modest portion of loose-mesh wire fencing along the north frontage. At the road intersections a portion of yard has been fenced off that was never formally acquired by the Company and is recorded in the Land Registry of the Municipality of Cortona on Sheet 232 - Parcel 172 - Area 258 sqm; moreover, the surface area annexed to the yard is less than the cadastral surface indicated above, as a portion of the parcel is annexed to the public road.
The complex is equipped with a forecourt intended for parking used cars, located across the regional road. The area is uncultivated land with compacted ground, on which the Company parked second-hand cars or cars on consignment. The land is completely fenced with loose-mesh wire and has pedestrian access from the regional road, facing the Company yard, and vehicular access from the municipal road running along the opposite frontage.
No authorizing permits were found for the construction of the fences nor for its use as a car park. In 2010 a DIA (591/2010) was submitted for the replacement of the fence along Regional Road 71 and the creation of a driveway access. The project obtained the favorable opinion of the Province of Arezzo. The Municipality of Cortona ordered that the works not be carried out as the area, at the time, was designated as public green space.
Please note therefore that throughout the complex there are various non-conformities, as better indicated and described in the attached appraisal report.
The residential properties, category A/3, constitute the partners’ residence and will be vacated pursuant to a release order, at the care and expense of the procedure, and, once the order has been carried out, they will be delivered by the Trustee to the purchaser free of persons and things.
The real estate complex includes the owned vehicles, equipment, furnishings and spare parts present in the warehouse, as better listed in the attached movable assets appraisal report ("Home Furnishings" and "Vehicles with Power of Attorney" are to be considered excluded).
With regard to registered movable assets, it is specified that all activities necessary to complete the formalities for the transfer of the related ownership are the responsibility of the successful bidder and must therefore be carried out at the successful bidder’s care and expense.
