The property appears to be occupied under a business lease agreement entered into on 09.07.2018, registered with the Revenue Agency on 09.02.2023 at no. 000442, telematic ID TSU23T000442000RI; the agreement provides for a lease term of six years starting from 01.02.2023 until 31.01.2029, with automatic renewal for an additional six years in the absence of termination notice. The annual rent is EUR 7,200.00 plus VAT.
In the event of a final award and subsequent transfer of the lot, the buyer shall take over the position of the lessor in the lease agreement and, specifically, all rights and obligations inherent to the relationship that have not been exhausted, until the expiry of the contract. The Judicial Liquidation is responsible for collecting the lease payments, including the one that will accrue for the entire current month at the time of signing the purchase agreement. The current tenant, if the final award occurs during the aforementioned lease relationship, has the right to exercise, on equal terms compared to the third-party winning bidder, a right of first refusal under the conditions set forth in Articles 38, 39, and 40 of Law 392/1978; the right may be exercised by the tenant only after the provisional award phase and based on the price reached during the sale, even if the tenant participated in the auction; accordingly, the Curator will send the tenant a notice of the award of the property, inviting the tenant to exercise or not the right of first refusal with regard to the award price; the exercise of the right of first refusal must occur within a maximum of 60 days from the sending of the notice by the curator; in case of exercise of the right of first refusal, the bidder and/or the winning bidder cannot make any claim against the Procedure itself for loss of profit and/or for costs incurred in submitting the relevant offer.
