    Descrizione (IT)IDENTIFICAZIONE DEL BENE OGGETTO DI PERIZIA (LOTTO A): Preliminarmente, il c.t.u., Ing. Di Mauro, nella perizia a sua firma agli atti della procedura, ha chiarito e precisato l’incommerciabilità dell’abitazione sul libero mercato. Per questo bene – costituente LOTTO A -  le operazioni peritali hanno avuto ad oggetto l’accertamento della natura non commerciabile del bene e quindi – ai fini della vendita giudiziaria, non soggetta alle restrizioni relativi agli immobili abusivi – la quantificazione di un valore d’uso da porre a base d’asta. In tal caso, l’acquirente conseguirà la piena proprietà del bene immobile staggito (di cui al Lotto A) ma – sotto il profilo edilizio ed urbanistico – nello stato di fatto e di diritto in cui esso si trova.Come descritto nella c.t.u. agli atti della procedura:Il Lotto A è costituito da una abitazione in Cagnano Varano alla Via S. Pertini, 4/A. L’abitazione si trova al piano terzo di un fabbricato di complessivi 6 livelli, di cui un piano completamente interrato con accesso da Via N. Paganini, un piano seminterrato con accesso da Via A. Vivaldi e 4 livelli interamente fuori terra con accesso da Via S. Pertini, senza ascensore. L’abitazione occupa l’intero ultimo piano, è composta da 6 ampi vani con doppi servizi e numerosi accessori, per complessivi 12,5 vani catastali. Dotata di un terrazzo a livello di oltre 100 mq, di cui 37 mq coperti.Il bene che costituisce il lotto è ubicato in Cagnano Varano (FG), in un condominio ai margini della zona edificata, all’intersezione tra Via A. Vivaldi e Via S. Pertini, con accesso dal portone condominiale su Via Pertini, civico 4/A.Si tratta di una unità immobiliare al piano terzo di un fabbricato di complessivi 6 piani di cui 4 fuori terra, uno seminterrato e uno interrato. Al livello del proprio piano, l’abitazione è dotata di un ampio terrazzo, in parte a sbalzo, sul lato est, mentre dal lato opposto, affacciato ad ovest, si contano complessivi 5 abbaini, trattandosi di un piano mansardato realizzato sotto la copertura.In Catasto, l’unità immobiliare pignorata è censita al foglio 34 del Comune di Cagnano Varano, particella 649, sub. 21, categoria A/2, consistenza 12,5 vani.CONFINI: Il c.t.u., nella perizia a sua firma agli atti della procedura, afferma che i confini catastali del bene immobile de quo, che coincidono con i confini del fabbricato perché il bene occupa l’intero ultimo piano, in senso antiorario, sono costituiti da Via A. Vivaldi sul lato ovest, porzione residua della p.lla 648 sui lati sud ed est (su cui insiste la viabilità privata per raggiungere i garage interrati) e Via S. Pertini sul lato nord.Come affermato dal c.t.u. nella perizia a sua firma agli atti della procedura, l’abitazione costituente il Lotto A è completamente abusiva perché il suo volume era altrimenti irrealizzabile (in zona sono consentiti soli 3 piani), perché l’intero volume – pur con caratteristiche di abitabilità – è stato illecitamente dichiarato come volume tecnico, perché le sue dimensioni eccedono qualunque dimensione astrattamente autorizzabile come volume tecnico.

IDENTIFICATION OF THE PROPERTY SUBJECT TO APPRAISAL (LOT A) as described in the expert report in the records of the procedure:
The lot consists of a residence in Cagnano Varano at Via S. Pertini, 4/A.
The residence is located on the third floor of a building with a total of 6 levels, including one completely underground floor with access from Via N. Paganini, one semi-basement floor with access from Via A. Vivaldi, and 4 levels entirely above ground with access from Via S. Pertini, without an elevator. The residence occupies the entire top floor, consists of 6 large rooms with two bathrooms and numerous accessories, for a total of 12.5 cadastral rooms. It is equipped with a terrace at level of over 100 sqm, of which 37 sqm are covered.
The property that constitutes the lot is located in Cagnano Varano (FG), in a condominium on the outskirts of the built-up area, at the intersection of Via A. Vivaldi and Via S. Pertini, with access from the condominium door on Via Pertini, civic 4/A.
It is a real estate unit on the third floor of a building with a total of 6 floors, of which 4 are above ground, one is semi-basement, and one is underground. At the level of its own floor, the residence has a large terrace, partly cantilevered, on the east side, while on the opposite side, facing west, there are a total of 5 dormers, as it is a mansard floor built under the roof.

In the Land Registry, the seized real estate unit is registered in sheet 34 of the Municipality of Cagnano Varano, parcel 649, sub. 21, category A/2, consisting of 12.5 rooms.

BORDERS:
The expert, in the appraisal signed by him in the records of the procedure, states that the cadastral boundaries of the property in question, which coincide with the boundaries of the building because the property occupies the entire top floor, in a counterclockwise direction, are constituted by Via A. Vivaldi on the west side, the residual portion of parcel 648 on the south and east sides (on which the private road for accessing the underground garages is located) and Via S. Pertini on the north side.
As stated by the expert in the appraisal signed by him in the records of the procedure, the residence constituting Lot A is completely illegal because its volume was otherwise unachievable (only 3 floors are allowed in the area), because the entire volume – despite having characteristics of habitability – has been unlawfully declared as technical volume, because its dimensions exceed any dimension that could be abstractly authorized as technical volume.
