The dwelling is located on the 1st floor (2nd above ground) of the building in Ciriè (TO), via degli Ontani n. 14, consisting of 2 rooms, living room, kitchen, entrance, bathroom, storage room, terrace and 1 balcony, with an adjoining cellar room in the basement, identified in the floor plans attached to the condominium regulations with the number "5" (dwelling) and the Roman numeral "V" (cellar)"; all as better identified in the deed of sale by notary Oscar Sebastianelli of Turin dated 07.04.1997, file no. 119047/12475, registered in Turin on 24.04.1997 at no. 10795.
The garage (car box) is located on the ground floor (1st above ground) of the low building in the courtyard in Ciriè (TO), via degli Ontani n. 14/A, identified in the floor plan attached to the condominium regulations with the number "23"; all as better identified in the deed of sale by notary Oscar Sebastianelli of Turin dated 18.03.1998, file no. 124079/13467, registered in Turin on 03.04.1998 at no. 8335.

The properties are occupied under a residential lease agreement signed on 31.01.2022, registered with the Revenue Agency office of Ciriè on 01.03.2022 at no. 00632, telematic ID TSU22T00632000PG; the contract provides for a lease duration of four years starting from 31.01.2022 until 30.01.2026, with automatic renewal for an additional four years in the absence of notice. The annual rent is euro 5,232.00.
In case of final award and subsequent transfer of the Lot, the buyer will take the place of the lessor in the lease agreement and, specifically, in all rights and obligations arising from the relationship that have not been fulfilled, until the expiry of the contract. The Judicial Liquidation is entitled to collect the lease payments, including the one that will accrue for the full month in progress at the time of signing the deed of sale. The current tenant, in the event that the final award occurs during the aforementioned lease relationship, has the right to exercise, under the same conditions as the third-party successful bidder, the pre-emption right under the conditions set forth in Articles 3 of Law 431/1998, 38, 39 and 40 of Law 392/1978; the right may be exercised by the tenant after the award and based on the price reached during the sale, even if the same has participated in the auction; consequently, the Curator will send the tenant the notice of the award of the property, inviting the tenant to exercise or not the pre-emption right with regard to the award price and the conditions of the notice; the exercise of the pre-emption right must take place within a maximum period of 60 days from the sending of the notice by the curator; in case of exercise of the pre-emption right, the offeror and/or the successful bidder cannot make any claim against the Procedure itself for loss of profit and/or for costs incurred for the submission of the relevant offer.
