Right of full ownership of a residential nucleus consisting of n. 4 lodgings, three of which consist of a ground floor and one of a ground floor and a first floor. All of them overlook a common courtyard. This housing nucleus is located in Deruta (PG), hamlet S. Nicolò di Celle, Str. Vicinale S. Filippo n. 6.
The whole property is fenced and equipped with an entrance gate. The pre-existing rural building dates back to before 1950. The renovation works of all the buildings date back to 1999-2000. The residential nucleus is made up of an original building two floors above ground and three outbuildings transformed into apartments. All buildings have a masonry load-bearing structure and internal partitions in perforated and some in masonry. The floors and roofs are cast and the roof is tiled. The external facades are plastered and painted yellow, except that of building "D" which is in stone. Inside the original building "A" two lodgings have been created, one on the ground floor and one on the first floor. In building "B" two lodgings have been created; in building "C" there are a reading and TV room, a recreation room and a toilet, rooms in common use for the entire nucleus; an accommodation has been created in building "D". The window frames are made of wood with double glazing and shutters. The internal and external doors are made of wood. The floors are made of single-fired tiles. The walls of the bathrooms and kitchens are covered with ceramic tiles. The residential nucleus consists of: 1) Building "A": PT. Living room, kitchen, study, n. 2 bedrooms, no. 2wc. All equal to rooms 4.5. 1st F. Living room, kitchen, dining room, n. 2 bedrooms, no. 1 bathroom, no. 1 shower. All equal to rooms 4.5. 2) Building "B": PT. Accommodation 1) Living room-kitchen, n. 1 bedroom, no. 1 bathroom. All equal to rooms 2.5. pt. Accommodation 2) Living room-kitchen, n. 1 bedroom, no. 1 bathroom. All equal to rooms 2.5. 3) Building "C": PT. Warehouse, recreation room, reading room, n. 1 toilet. All equal to 3 rooms. 4) Building "D": PT. Living room-kitchen, n. 1 bedroom, no. 1 closet, n. 1 toilet. All equal to 3 rooms. The entire residential nucleus is made up of 20 rooms. Total surface gross of internal dividers mg. 467.752, floor area 440.364 sq m. The entire property is fenced with stone walls and wrought iron railings and gates. The assets in question are not registered in the way they are now as they were illegally performed. At the N.C.E.U. of the Municipality of Deruta there is only the land registry of the pre-existing two-storey high residential building which is registered as follows: Sheet no. 2 particle no. 157: 1) Sub. 2, cat. C/6, cl. 2, sq.m. 19, RC €18.64; 2) Sub. 3, cat. C/6, cl. 2, sq.m. 19, RC €18.64; 3) Sub. 4, cat. A/3, cl. 2, rooms 10.5, RC € 623.62 Sheet no. 2 particle no. 204 stapled with parcel no. 157 sub. 4
The area where the residential nucleus is located is not subject to any restrictions. The first renovation concerns the pre-existing building A and a Concession in Amnesty n. 120/00 which has never been withdrawn. The conditions imposed in order to be withdrawn is that a building is demolished due to lack of regulatory distance and that the room used as a study on the ground floor is changed into a closet as the environment does not have the legal heights. A concession in Amnesty was requested as an implementation plan for the restructuring and change of use of the annexes (buildings BC-D) n. 121/00. The opinion of the Municipality was negative. There is an ordinance of reduction to restoration n. 84 of 12.20.1999. From the investigations carried out in the Urban Planning Office of the Municipality of Deruta, illegal renovation works emerge. Following a visit by the traffic policemen of the Municipality of Deruta who disputed the irregularity, the request was presented, with the appropriate technical documents, for concession in amnesty which the municipality denied. Therefore, as regards the renovated outbuildings, they are illegal and must be restored to their initial use. An appeal relating to the practices denied by the Municipality of Deruta was presented on 9.12.2000.
