SALE SUSPENDED AS PER DELEGATE JUDGE PROVISION OF 30/04/2024

The lot consists of:

- Rural plots located in the territory of the Municipality of Portopalo di Capo Passero (SR), bordering and/or facing via Anime Sante, contained between via Vincenzo Bellini and the coastal area, extended overall in cadastral measure ha 12.78.40, all registered to the Land Registry of the Municipality of Portopalo di Capo Passero sheet 42 parcels 252, 249, 130, 143, 133, 156, 144, 149, 151, 99, 129, 108, 107, 1649 and 1636;
- Real estate located in the territory of the Municipality of Portopalo di Capo Passero (SR), falling within the same sector as the rustic funds forming part of the lot, in a state of abandonment and registered as collaborating units, all registered in the register of buildings of the Municipality of Portopalo of Capo Passero sheet 42 parcel 1584/1 and 1399/2.

With reference to the investigations carried out by the technical consultant in terms of urban planning - building and cadastral regularity of the land in question, it should be noted that the examination of the report revealed the following:
the rustic funds have a prevalent urban destination "E" in residual part for Viability - Parking where there are various urban planning constraints including, for part of the funds, the non-building limit pursuant to Regional Law 78/76; please refer to the certificate of urban destination issued on 10/27/2021 (it is represented that with certified email dated 4/18/2023, for which the Municipality of Portopalo di Capo Passero communicated with certified certified email dated 4/18/2023 that " the urban planning destinations indicated in the TOC of 10/27/2020 to date are unchanged");
The properties registered as collaborating units were built prior to 1967.

It is also noted that:

- the Curatorship has received notification of a summons with which the Court has been asked to issue a sentence against the Bankruptcy which, pursuant to art. 2932 of the Civil Code, produces the effects of the unconcluded definitive contract and transfers ownership of the properties described above to the plaintiff;

- that, pursuant to and for the purposes of art. 45 L. F., the aforementioned contract is not transcribed;

- that the Trustee, subject to authorization from the CoC, in appearing in the aforementioned proceedings, will declare his desire to dissolve pursuant to art. 72 L. F. from the contract for the hypothesis in which he were to attribute to the same a mandatory nature;

- that the Curatorship has notified the notice of sale to the plaintiff and that the latter has not lodged any appeals against the aforementioned notice.

Il lotto si compone di: - Fondi rustici siti nel territorio del Comune di Portopalo di Capo Passero (SR), limitrofi e/o prospicienti via Anime Sante, contenuti tra la via Vincenzo Bellini e la zona litorale, estesi complessivamente in misura catastale ha 12.78.40, il tutto censito al catasto dei terreni del Comune di Portopalo di Capo Passero foglio 42 particelle 252, 249, 130, 143, 133, 156, 144, 149, 151, 99, 129, 108, 107, 1649 e 1636; - Beni immobili siti nel territorio del Comune di Portopalo di Capo Passero (SR), ricadenti nel medesimo comparto dei fondi rustici facenti parte del lotto, in stato di abbandono ed allibrati come unità collabenti, il tutto censito al catasto dei fabbricati del Comune di Portopalo di Capo Passero foglio 42 particella 1584/1 e 1399/2. Con riferimento agli accertamenti compiuti dal consulente tecnico sotto il profilo della regolarità urbanistico – edilizia e catastale dei terreni in questione si fa presente che dall’esame della relazione è emerso quanto segue: i fondi rustici hanno destinazione urbanistica prevalente “E” in parte residuale per Viabilità – Parcheggi ove insistono vari vincoli urbanistici tra cui, per parte dei fondi, limite di inedificabilità di cui alla L.R. 78/76; si rimanda al certificato di destinazione urbanistica rilasciato in data 27/10/2021 (si rappresenta che con pec del 18/4/2023, per il quale il Comune di Portopalo di Capo Passero ha comunicato con pec del 18/4/2023 che “le destinazioni urbanistiche indicate nel C.D.U. del 27/10/2020 alla data odierna risultano immutate”); I beni immobili allibrati come unità collabenti sono stati edificati antecedentemente al 1967. Si fa inoltre presente che: - la Curatela ha ricevuto la notifica di un atto di citazione con il quale si è chiesto al Tribunale di emettere contro il Fallimento sentenza che, ai sensi dell’art. 2932 c.c., produca gli effetti del contratto definitivo non concluso e trasferisca all’attore la proprietà degli immobili sopra descritti; - che, ai sensi e per gli effetti dell’art. 45 L. F., il citato contratto non risulta trascritto; - che il Curatore, previa autorizzazione del CdC, nel costituirsi nel citato giudizio, provvederà a dichiarare la propria volontà di sciogliersi ex art. 72 L. F. dal contratto per l’ipotesi in cui dovesse attribuire allo stesso natura obbligatoria; - che la Curatela ha provveduto a notificare l’avviso di vendita all’attore e che quest’ultimo non ha proposto impugnazioni avverso il citato avviso.
