Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Étant donné qu'il s'agit d'un lot unique ayant pour objet le transfert de la pleine propriété, une fois l'adjudication effectuée, ledit droit de superficie grevant la p.f. 4097/5 s'éteindra par consolidation de la nue-propriété et de la propriété superficielle au même sujet.
Conformément au PGT en vigueur depuis le 02/12/2015, identifié comme "Variante Générale au PGT - Mars 2015" approuvé par la Junte Provinciale par délibération n. 2056 du 20/11/2015, la zone en question est définie comme "P.A.G. 9", réglementée selon les "Dispositions particulières des Plans d'Aménagement" de l'article 64 des règles d'application.
Par décision n. 2170 du 29/07/2021, le Directeur de la Province Autonome de Trente a autorisé les techniciens de l'administration provinciale à accéder aux terrains en vente afin d'effectuer les opérations nécessaires à l'élaboration du projet "Réalisation d'un échangeur pour Sano à Mori (intégration)"; cette autorisation est valable pour une période de deux ans à compter de la notification ou de la communication de ladite mesure.
La société en faillite (Fall. n. 19/2015) propriétaire des 35 200 m², a déjà versé à la commune des frais d'urbanisation d'un montant d'environ 925 000,00 €.
Pendant le déroulement des opérations de vente, le Mandant se réserve le droit d'accepter des offres d'un montant inférieur au prix de base susmentionné dans la limite de 25% (sous réserve de reconnaissance du Buyer's Premium correspondant). Elles seront évaluées après la fin de l'enchère à l'appréciation incontestable des Organes de la Procédure.
