The 30-day period within which the successful bidder must pay the balance of the purchase price shall commence on the date on which clearance is obtained from the A.N.B.S.C.
Availability of Lots
Ownership shall be transferred by notarial deed only after full payment of the successful bid price, plus VAT, expenses and the Buyer’s Premium (plus VAT), and, in any event, only after the relevant checks regarding anti-mafia information have been carried out with the BDNA.
Any registrations relating to rights of first refusal, records of foreclosures and preventive seizures, and any other encumbrances on the assets offered for sale shall be cancelled once the sale has been completed and the price has been paid in full. All formalities for cancellation shall be carried out at the expense of the seller.
Please note that the following provisions must be included in the body of the sale and purchase agreement:

- a condition that, pursuant to the combined provisions of Articles 48, paragraph 5 and 48, paragraph 15 ter of the CAM, the business assets purchased may not be disposed of, even in part, for five years from the date of registration of the sale agreement;

This clause shall enable the A.N.B.S.C., in the event of a subsequent sale, to verify, as a condition necessary for the transfer of the asset, the absence of "disclosable" criminal judicial measures and/or preventive measures against the person identified as the new tenant or purchaser. The aforementioned clause must be included in any subsequent transfer deeds executed during the same three-year period.
