SPECIFIC TERMS AND CONDITIONS

By submitting an offer, the bidder declares that they have fully reviewed and accepted these terms of sale and all documentation made available. If a notice of sale is attached to the auction listing/advertisement, by submitting an offer the bidder declares that they have reviewed and accepted the conditions set out therein, of which these terms of sale are to be understood as an extract. The bidder further declares that they have examined and accepted all documentation made available for the purposes of participation.

Deposit

Participation in the offer collection is subject to payment of a mandatory security deposit equal to 10% of the offer price.

Participation Rules

Participation in this sale is governed by the conditions set out in the attached Notice of Sale, which the user is required to review.

Availability of Lots

Any registrations relating to pre-emption rights, records of attachments and conservatory seizures, and any other encumbrances affecting the assets offered for sale, will be cancelled pursuant to Article 108 of the Bankruptcy Law once the sale has been completed and the full price has been collected. All formalities for cancellation will be carried out at the successful bidder's expense.

Payment deadline

Lots awarded to the user must be paid for in full within 90 days of the award and in any event no later than the date set for the transfer of ownership.

The Buyer's Premium due must be paid within 20 days of the award.

Expenses relating to the sale payable by the purchaser (tax and non-tax charges, statutory taxes, notary fees) must be paid no later than the date set for the transfer of ownership. 



Buyer's Premium: A percentage fee + VAT will be added to the winning bid price of each lot, including in the case of offers received within the time limit set out in Article 107, paragraph 4 (Bankruptcy Law).
 
 
The percentage fee mentioned above will be applied according to the procedures set out in the following table:

The calculation base for the Buyer's Premium is divided into several tiers, each of which is subject to a decreasing rate as the tiers increase.

For each winning bid price, the corresponding Buyer's Premium will be the sum of the fees calculated on each respective tier, according to the procedures set out in the table above. 

VAT: VAT at 22,00% of the sale price will be calculated on the winning bid price of each lot (where applicable).
The applicable VAT rate may vary as required by law.



In the event of any disputes concerning the interpretation of the provisions contained in the general and specific terms and conditions published on the platform, which may have been translated into other languages, the Italian version of the text shall prevail.
