Deposit

The present auction is subject to a deposit of  EUR 328.800,00.

Lots Availability

Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.

Property transfer

The transfer of ownership will take place only after full payment of awarding price and expenses by means of a notarial deed.

Payment deadline

Awarded lots have to be paid in full within 30 days from the provisional awarding.

Buyer's premium due (plus VAT) has to be paid within 10 days from awarding.

Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 30 days from the provisional awarding.


Buyer's Premium

A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law). 
 
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.

For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.


VAT: 
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)


In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Italian language version of such texts

Poudarja se, da so pri inštalacijah v oceni zajete le tiste, ki niso bile odtujene s prenosom dela podjetja, izvedenim dne 26. 1. 2024; v listini je navedeno, da so bili v prenos vključeni predmeti, oprema, stroji, naprave, namenjeni proizvodnji za izvajanje pogodb, navedenih v listini, ter vsa laboratorijska oprema in oprema za raziskave & razvoj, opisani v seznamu PRILOGA "C" k listini. (glej Pril. 5)

NAJEMNE POGODBE:
- najemna pogodba za ne-stanovanjsko rabo, sklenjena dne 26. 1. 2024, za dobo 6+6 let od 26. 1. 2024; najemnina 180.000,00 € letno + DDV, četrtletni obroki vnaprej 45.000,00 € + DDV. Najemna pogodba je bila sklenjena na podlagi pogodbe o prenosu dela podjetja, ki se nanaša na polno in izključno lastništvo poslovne enote za dejavnost proizvodnje kablov in anten različne narave za avtomobilske, tovorne in off-highway trge, sestavljene iz vseh osnovnih sredstev, dobrin, pravic, ki so temu delu podjetja posebej pripadajoče. Zlasti so bili v poslovni sklop, ki je predmet prenosa, vključeni predmeti, oprema, stroji, naprave, kalupi, linije, tehnična dokumentacija, ki se nahajajo v kompleksu Isola Vicentina, omejeno na tiste, namenjene proizvodnji za izvajanje pogodb, navedenih v listini, ter vsa laboratorijska oprema in oprema za raziskave & razvoj.
- najemna pogodba v korist tretjih oseb za parkirišče, z dne 8. 7. 1997, s privatno listino, trajanje 6+6 let od 15. 7. 1997 do 15. 7. 2003 z obnovitvijo, razen odpovedi; najemnina 12.000.000 L/letno – mesečni obroki vnaprej 1.000.000 L, pril. glede zemljišča v Isola Vicentina, list 16, m.n. 255.

SLUŽNOSTI
- služnosti v korist Enel, vpisane AE Schio dne 4/4/1995 pod št. 2662/2124 in dne 4/4/1995 pod št. 2663/2125, navedene v listini o izvoru lastništva z dne 13. 10. 1995 št. 95172, notar G. Carraro.
- služnost vodovoda v korist Občine Isola Vicentina, navedena v listini o izvoru lastništva z dne 19. 04. 2001 št. 72537, notar G. Rizzi, vzdolž zahodne meje med prvotnima m.nn. 476 in 438; v projektni dokumentaciji je cev občinskega vodovoda označena poravnana približno 1,50 m od vzhodne meje prvotnega m.n. 438.
