Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.
Payment deadline
The balance of the auction price must be paid into the current account indicated in the procedure within 120 days of the (provisional) awarding, to allow for the notarial deed of sale. This can be done by: allocating the sums paid as a deposit to the price account, as well as the remaining balance of the price, by bank draft and/or bank transfer. The details, IBAN code, and reason for payment will be provided by the Receiver as the balance for the remaining amount. Failure to do so will result in the loss of the deposit provided and the award being forfeited, without prejudice to compensation for greater damages pursuant to Articles 587 of the Italian Code of Civil Procedure and 177 of the implementing provisions of the Italian Code of Civil Procedure. The bank details may also be changed by the Bankruptcy Trustee by simply sending a certified email (PEC) to the winning bidder.
Given the peremptory deadline of 120 days for the payment of the remaining balance of the price, it will be the sole responsibility of the successful bidder to make the bank transfer for the balance due, at least 3 (three) working days before the deadline.
Expenses, taxes, and any other charges related to and due for the sale must be paid into the bank account communicated by the notary at least 2 (two) days prior to the signing of the deed of sale. All such payments are the responsibility of the successful bidder. Failure to do so will result in the sale being cancelled and the award being automatically revoked, with the relevant consequences set forth in the previous conditions.
All expenses and charges, including notary and tax charges (registration, transcription, transfer, cancellation of prejudicial charges, etc.) related to the sale will be borne entirely and exclusively by the successful bidder/buyer, who expressly waives all liability for the Procedure.
Buyer's premium due (plus VAT) has to be paid within 10 days from awarding.
Property transferThe transfer of the property will take place through a notarial deed of sale, which must be drawn up within and no later than
140 days of the awarding, under the authority of a Notary, of which the Curator will communicate the day and date via certified email to the Successful Bidder within the following
7 (seven) days of payment of the remaining price balance.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
The Buyer's Premium will have a minimum amount of € 500.00 (+ VAT at 22% where applicable) as minimum commissions billable if the reference percentage applied to the sales value is lower
VAT on Lot:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
