The present auction is subject to a deposit of

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.
Payment deadline
Awarded lots have to be paid in full within 90 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 10 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 90 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
Lot VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Peritzan azpimarratutako bezala, ikusgai dauden pilak material argilosoz osatuta daudela, zati batean terrak frakzionatuekin nahastuta. Halaber, frakzionatutako materialez osatutako hondakin pilak daudela azpimarratu behar da, landarediak estalitakoak.
Ez da hainbat sakonera desberdinetan ikerketarik egin. Ez da elementu erabilgarririk aurkitu ingurumen kalitatearen egiaztapenerako, ezta ingurumen kalitatearen baldintzak egiaztatzeko analisi kimikorik ere.

Ebaluazio labur bat egiteko, bi lurraren lagin hartu dira, peritzako 2.6 atalean deskribatutako moduan, analisi kimikora bidaliak. Proba txostenen ebidentzien arabera, parametroak D.Lgs 152/06 eta s.m.i., Titulu V, Atx. 5 - Taula 1 - Alerako zutabean (erabilerako, berde publiko, pribatu eta bizitegi gisa) onartutako muga barruan daude. Ez da transferentzia probak egin.
Salmenta egungo egoeran eta eskubideetan, baita urbanistikoan ere, lurrak dauden moduan egiten da eta behartuta dago, beraz, akats edo kalitate falta araudiari lotuta ez dagoen moduan, ezta inolako arrazoirengatik ere ezeztatu daiteke: akatsak, kalitate falta edo salmentan dagoen objektuaren desberdintasunak, edozein motatako kargak, edozein arrazoirengatik ez kontuan hartuta, nahiz eta ezkutatuak izan, eta peritzan azpimarratu ez direnak, ez dute inolako kalte-ordain, konpentsazio edo prezio murrizketa ekarriko.
Ondasunaren transferentziaren bidez, irabazleak hondakinak garbitzeko eta kudeatzeko ekintzen inguruko karguak bere gain hartzen ditu, nahiz eta ezkutatuak izan, peritzan deskribatuak eta ez, eta ez du ezer salatu ahal izango Prozedurari eta/edo Enkante Etxeari.
Salmenta gorputz gisa egiten da, eta ez neurriz, beraz, neurrien arteko desberdintasunek ez dute inolako kalte-ordain, konpentsazio edo prezio murrizketa ekarriko.
Irabazleak salmentarako aurreko zatien inguruko kostuak bere gain hartzen ditu, peritzan deskribatutako moduan, jada enkantean oinarritutako likidazio balioaren murriztuta daudenak.
