Deposit
To participate in the Auction, a specific deposit for each lot must be paid.
The deposit must be made via:

Reference: (auction number and lot number)
The deposit must be received before the end of the Auction.
Only after the deposit is received will the user be authorized to participate in the Auction.

Privileged creditors related to real estate in this auction are exempt from the deposit to bid for the lots over which they hold a credit. They must send an email stating their position and submit the required documentation for participation, excluding the deposit payment proof.
Users who participated but were not awarded any items will receive their deposit back within 20 working days after the end of the auction, without interest.
If the bidder does not complete the purchase by paying the final price and Buyer’s Premium after winning the auction, the deposit will be retained.
In such case, the lot will not be awarded to the next highest bidder, and a new auction will be organized according to the rules established by the Insolvency Administrator.
Encumbrances and Liens
The sale will be free from encumbrances and liens, except for rights in rem, legal burdens, and urban charges.
Taxes and duties related to the award or transfer of each asset will be borne by the awarded bidders or buyers, including notary fees, registration costs, and any other related to the sale. Under no circumstances will the bankrupt entity bear any sale-related costs.
Likewise, any outstanding amounts related to Property Tax, urbanization fees, community expenses, or unpaid charges will be borne by the buyer.
Cancellation orders for encumbrances will be issued only by the Court upon proof of transfer and, for encumbered assets, after payment to the privileged creditor.
The Insolvency Administrator will request the Court to cancel any registrations or embargoes related to the proceedings, and such costs shall be borne by the buyer.
Lot Awarding
The sale will take place without a minimum price, though the Insolvency Administrator reserves the right to reject offers deemed insufficient. Accepted offers will receive provisional award confirmation from the auction house, binding the bidder to pay the offered amount.
Warning: The Insolvency Administrator may communicate the winning bid to the Court for approval. Only after Court approval will confirmation be sent with payment instructions.
Participation Method
To participate in the auction, users must register at www.gobid.es, provide personal data, request participation, and accept the terms.
The data provided during registration will be used for awarding and ownership purposes.
All payments, before and after the auction, must be made by registered users. Powers of attorney will only be considered if authorized by the principal.
Users must transfer the required deposit to the account mentioned above.
They must indicate the auction number and lot numbers and send proof of transfer to info@gobid.es.
The deposit must be received before the auction ends.
In addition to the deposit, participants must send the following documentation to info@gobid.es:
INDIVIDUALS:
Valid ID of the person to whom ownership will be transferred.
If married in community property regime, spouse’s ID must also be submitted (non-binding unless awarded).
COMPANIES/ENTITIES:
Articles of incorporation showing company formation and bidder’s powers.
Valid ID of the legal representative.
Sworn translation of incorporation if the company is not Spanish.
Notarized power of attorney if represented by a third party.
Payment Terms
The Buyer’s Premium must be paid by bank transfer to the account provided at registration or with the award confirmation (see general conditions).
The provisional awardee must transfer the total price + VAT (if applicable) to the bankrupt’s account within the given deadline (see general conditions).
All notary, property transfer, and registration cancellation fees must be paid before the formalization date. Ownership transfer via public deed will occur after full payment.
Payment Deadline
The Buyer’s Premium and any administrative fees must be paid within 10 days from award confirmation.
The lot price must be paid within 30 days from award confirmation.
The payment of the Buyer’s Premium for lots 2 and 3 must be made within 10 days from the communication of the award.
With authorization, the lot price may be paid at the notarial sale formalization.
Transfer of Ownership
Transfer will be formalized via public deed per the Administrator’s instructions, only after full payment of the awarded price, Buyer’s Premium, and any related costs.
This must occur within 30 days from award confirmation (extendable only by the Administrator).
The Principal will request the Judicial Secretary to lift any embargoes or liens. Costs will be borne by the awardee.
If the awarded bidder fails to attend document signing, they may be deemed to have renounced their bid, and the Buyer’s Premium will be forfeited as indemnification.
Administrative costs, fully borne by the awardee, cover sale formalization services, not exceeding €300. The exact amount appears in the lot description under "administrative costs".
Possession of the property will not be delivered until the liquidation and removal of the bankrupt party’s movable assets present in the property have been completed.
Withdrawal Conditions
Withdrawal must be completed within 20 days from provisional award confirmation.
GOBID ESPAÑA S.L will notify awardees of withdrawal dates and times via email. These may also appear on the auction site. GOBID ESPAÑA S.L reserves the right to change them.
If withdrawal must occur on different dates, an additional fee of €250.00–€350.00 + VAT per extra day may apply.
If the awardee fails to withdraw on the scheduled date without 48-hour notice, a €350.00 penalty will apply. Additional compensation may be due.
Unwithdrawn lots after 30 days from the final date may result in contract termination, with amounts paid retained as compensation.
GOBID ESPAÑA S.L is not obligated to deliver or organize the withdrawal/delivery of lots.
Buyers must ensure safety compliance during withdrawal, even when third parties are involved.
The awardee is responsible for disassembly, transport, and transfer procedures, especially for vehicles.
No lot will be released until all payments are made and, for registered movable goods, ownership transfer is completed.
Other Specific Conditions
Buyer’s Premium: The final awardee must pay a commission of 5,00% on the final award price + 21% VAT (if applicable), plus any administrative costs indicated in the lot’s data sheet.
A minimum commission of €50 + VAT applies per awarded lot/combo.
This commission and any administrative expenses are always borne by the buyer, even if a privileged creditor.
Administrative Expenses: Additional costs entirely borne by the awardee to cover auction preparation, management, and post-sale services. To be paid with Buyer’s Premium upon provisional award confirmation. If applicable, they are shown in the lot’s description.
Assets With Privileged Credit
Privileged creditors are exempt from the deposit.
They may assign the awarded lot to another.
If awarded, the privileged creditor must still pay the auction house commission.
Proportional Value Lot 0: Lot 0 includes real estate and movable goods (installations). The value is split: Registered Properties 65068 and 65070 = 85.43%, installations = 14.57%. Auction proceeds will be distributed accordingly.
Award Taxes: VAT or applicable taxes will apply according to regulations and the awardee’s status.
Bids on Entire Lot:
If no offers are received for Lot 0 (entire lot), individual lots will be awarded if they received bids. If both are bid on, the Administrator will decide which to award based on values.
Extra-Time:
If a bid is placed within the last 5 minutes, 5 more minutes will be added. Auto-bids (proxy bids) count for time extension.
Awardees may not claim for physical/legal defects or discrepancies in the assets. By bidding, they accept the asset as-is and waive any rights of rescission or warranty, including hidden defects (Art. 1.474 Civil Code).
All disposal costs, including withdrawal, transport, transfer, and cancellation of encumbrances, are at the buyer’s expense.
No post-sale guarantees apply for non-compliance or defects, and no legal action for compensation will be accepted.
