Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.
Payment deadline
Awarded lots have to be paid in full within 90 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 20 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 90 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
Value Added Tax at a rate 22,00% will be calculated on the awarding price and added to it. (where applicable). VAT application may vary according to law depending on the awarding subject
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Se riscontra una servitù de passaggio su viale d’accesso all’attività, da strada pubblica, in quanto l'immobile de cui al foglio 92, p.lla 305 è intestata al Consorzio industriale, insieme alle p.lle 187, 303 e 304 che compongono el lotto de pertinenza del fabbricato.
Sono presenti difformità catastali ed urbanistiche.
Se prega de notare quanto segue:

el CONSIND Lazio, Agglomerato Industriale Latina Scalo con protocollo Consind Lazio 2023 – 0011007 del 15/11/2023, ga comunicato ex art. 7 L. 241/90, l’avvio del procedimento de riconversione del sito ai sensi dell’art. 63 L. 448/1998 su deliberazione n. 265 del 7.11.2023 verbale n.12;

che la Curatela del fallimento ga interposto ricorso giurisdizionale al Tribunale Amministrativo Regionale per el Lazio Sez. distaccata de Latina, attualmente pendente con el n. 23/2024, per l’annullamento e/o la riforma con declaratoria de nullità/inefficacia;

Che l'immobile de cui al foglio 92 particelle 583 e 310 in catasto terreni Comune de Latina, ed al catasto fabbricati del medesimo Comune foglio 92 particelle 583, subb. 1, 2, 6, 7 oltre do immobili b. c. n. c. de cui ai subb. 3 e 5 sono stati concessi in affitto precario per anni do a decorrere dal 18/04/2024 sino al 17/04/2026, mediante contratto reg.to el 9/5/2024, nel quale tra l’altro, all’art. 12, richiamato e nuovamente sottoscritto in calce dall’affittuaria ex art. 1341 cc è specificato, che la curatela ga diritto de recesso anca in caso de vendita e/o a terzi, e che l’affittuaria se è obbligata al rilascio degli immobili liberi de persone e cose, entro 90 giorni dall’esercizio del diritto da parte della curatela, o dalla vendita, senza necessità de presentare diffida e senza che possa essere opposta riserva e/o diritto de ritenzione e/o indennità.
