The present auction is subject to a deposit of

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Upozorňujeme, že majetok sa predáva v celku, keďže bola uzatvorená predbežná zmluva o predaji zo dňa 04/05/2022, riadne zapísaná, ktorá sa týka prevodu v prospech spoločnosti v konkurze - už vlastníka podielu 1/2 - alebo na tretie osoby, ktoré budú menované, zvyšného podielu pozemkov, ktorý bude teda prevedený po pridelení.
Stavebné pozemky s rozlohou 12.425 m² spadajú do stavebného sektora označeného C3.2 Lu Gialdinu a nachádzajú sa v podzónach C1.10 (čl. 35 NTA Územného plánu obce Santa Teresa Gallura) a sú predmetom parcelácie s obmedzeniami a stavebnými a urbanistickými obmedzeniami vyplývajúcimi z aplikácie normy vzťahujúcej sa na podzónu C1.10.
Správca si vyhradzuje právo prijímať a hodnotiť ponuky nižšie ako základná cena uvedená v limite 25%.
Tieto ponuky budú hodnotené iba po uplynutí tejto aukcie na výhradné posúdenie orgánov konania, výlučne v prípade absencie neodvolateľných ponúk vo výške rovnajúcej sa alebo vyššej ako základná cena.
Aby ste mohli predložiť ponuku za vyššie uvedených podmienok, prípadní záujemcovia NEMUSIA dodržiavať postup "DOKONČENIE PONÚK ZA ZÁKLADNÚ CENU AUKCIE", ale budú povinní zaslať žiadosť na adresu pec [email protected] na zistenie spôsobu predloženia a prijatie príslušného formulára ponuky.
V každom prípade budú neodvolateľné ponuky na kúpu predložené na základe vyššie uvedených podmienok podliehať aplikácii Buyer’s Premium plus zákonnej DPH, ako je uvedené v všeobecných a špecifických podmienkach a v priloženom oznámení o predaji.
