Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.
Payment deadline
Awarded lots have to be paid in full within 90 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 20 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 90 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
Value Added Tax at a rate 22,00% will be calculated on the awarding price and added to it. (where applicable). VAT application may vary according to law depending on the awarding subject
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Er is een doorgangsrecht op de toegangslaan naar de activiteit, vanaf de openbare weg, aangezien het onroerend goed op blad 92, perceel 305, is geregistreerd op naam van het Industrieconsortium, samen met de percelen 187, 303 en 304 die het perceel van het gebouw vormen.
Er zijn afwijkingen in de kadastrale en stedelijke registratie.
Let op het volgende:

de CONSIND Lazio, Industrieel Agglomeratie Latina Scalo met protocol Consind Lazio 2023 – 0011007 van 15/11/2023, heeft meegedeeld ex art. 7 L. 241/90, de start van de procedure voor de herbestemming van de site volgens art. 63 L. 448/1998 op basis van besluit nr. 265 van 7.11.2023, verslag nr. 12;

dat de curatele van het faillissement een rechtszaak heeft aangespannen bij de Regionale Administratieve Rechtbank voor Lazio, afdeling Latina, momenteel hangende met nr. 23/2024, voor de annulering en/of herziening met verklaring van nietigheid/invaliditeit;

Dat het onroerend goed op blad 92 percelen 583 en 310 in het kadaster van gronden van de Gemeente Latina, en in het kadaster van gebouwen van dezelfde Gemeente blad 92 percelen 583, subb. 1, 2, 6, 7 plus twee onroerende goederen b. c. n. c. van subb. 3 en 5 zijn tijdelijk verhuurd voor twee jaar, te beginnen op 18/04/2024 tot 17/04/2026, via een contract geregistreerd op 9/5/2024, waarin onder andere, in art. 12, opnieuw ondertekend door de huurder ex art. 1341 cc, is gespecificeerd dat de curatele het recht heeft om te annuleren, ook in geval van verkoop en/of aan derden, en dat de huurder zich heeft verplicht om de onroerende goederen vrij van mensen en zaken vrij te geven, binnen 90 dagen na uitoefening van het recht door de curatele, of na de verkoop, zonder dat een ingebrekestelling hoeft te worden ingediend en zonder dat er een voorbehoud en/of recht van retentie en/of schadevergoeding kan worden ingeroepen.
