Deposit
The present auction is subject to a deposit of

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Si evidenzia che i beni vengono posti in vendita per l'intero, considerato che è stato stipulato contratto preliminare di compravendita di data 04/05/2022, regolarmente trascritto, avente ad oggetto il trasferimento a favore della società fallita - già proprietaria della quota di 1/2 - o a terzi da nominare della restante quota dei terreni, che verrà quindi trasferita dopo l'aggiudicazione.
I terreni edificabili di mq 12.425 mq ricadono nel comparto edificatorio denominato C3.2 Lu Gialdinu e ricadente in sottozona C1.10 (art. 35 NTA Piano Urbanistico Comunale di Santa Teresa Gallura) e comunque area soggetta a lottizzazione con i limiti e i vincoli edilizi-urbanistici come derivanti dall’applicazione della norma di riferimento alla sottozona C1.10.
Il Curatore si riserva la facoltà di ricevere e valutare offerte di importo inferiore al prezzo base sopra indicato nel limite del 25%.
Tali offerte saranno valutate solo dopo il termine della presente asta a insindacabile giudizio degli Organi della Procedura, unicamente in assenza di offerte irrevocabili di importo pari o superiore al prezzo base.
Al fine di formulare un’offerta alle condizioni appena descritte, gli eventuali interessati NON dovranno seguire l’iter di "PERFEZIONAMENTO DELLE OFFERTE A PREZZO BASE D’ASTA", ma saranno tenuti ad inviare una richiesta all’indirizzo pec gorealbid@pec.it per conoscere le modalità di presentazione e ricevere il relativo modulo offerta.
In ogni caso, le offerte irrevocabili di acquisto presentate in base alle sopra menzionate condizioni saranno sottoposte all’applicazione del Buyer’s Premium oltre Iva di legge, come indicato nelle condizioni generali e specifiche e nell'avviso di vendita in allegato.
