Deposit
The present auction is subject to a deposit of

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Ističe se da se imovina prodaje u celini, s obzirom na to da je zaključen preliminarni ugovor o kupoprodaji od 04/05/2022, redovno upisan, koji se odnosi na prenos u korist društva u stečaju - već vlasnika dela od 1/2 - ili trećim licima koja će biti imenovana za preostali deo zemljišta, koji će biti prenet nakon dodele.
Građevinska zemljišta od 12.425 m² spadaju u građevinsku zonu označenu kao C3.2 Lu Gialdinu i pripadaju podzoni C1.10 (član 35 NTA Urbanističkog plana Opštine Santa Teresa Gallura) i u svakom slučaju su predmet parcelacije sa ograničenjima i urbanističkim pravilima koja proizlaze iz primene relevantne norme na podzonu C1.10.
Kurator zadržava pravo da primi i proceni ponude niže od gore navedene osnovne cene do 25%.
Te ponude će biti ocenjene samo nakon završetka ove aukcije po diskrecionom pravu Organa Procedure, isključivo u odsustvu nepovratnih ponuda u iznosu jednakom ili višem od osnovne cene.
Kako bi se podnela ponuda pod upravo opisanim uslovima, eventualni zainteresovani NE TREBA da prate postupak "USAVRŠAVANJA PONUDA PO OSNOVNOJ CENI AUKCIJE", već su obavezni da pošalju zahtev na adresu pec gorealbid@pec.it kako bi saznali način podnošenja i primili odgovarajući obrazac ponude.
U svakom slučaju, nepovratne ponude za kupovinu podnete na osnovu gore pomenutih uslova biće podložne primeni Kupčevog premija plus zakonski PDV, kao što je navedeno u opštim i specifičnim uslovima i u obaveštenju o prodaji u prilogu.
