Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.
Payment deadline
Payment of awarding price must take place on account indicated by the procedure within the time limit not exceeding 90 days from awarding.
Buyer's premium due (plus VAT) has to be paid within 20 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 90 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
De percelen 1096 en 1120 - Blad 42 zullen worden overgedragen aan de gemeente Portopalo di Capo Passero in overeenstemming met de voorwaarden van het bouwplan voor de infrastructuurwerken.
Er wordt opgemerkt dat uit het onderzoek van het rapport is gebleken dat de landbouwgronden, grenzend aan en/of tegenover het Bouwplan Anime Sante, grotendeels een stedenbouwkundige bestemming "E" hebben en gedeeltelijk resterend voor Wegen - Parkeerplaatsen waar verschillende stedenbouwkundige beperkingen gelden, waaronder, voor een deel van de percelen, een bouwverbod zoals bepaald in de L.R. 78/76; wordt verwezen naar het stedenbouwkundig bestemmingscertificaat afgegeven op 27/10/2021 (wordt opgemerkt dat met pec van 18/4/2023, waarbij de gemeente Portopalo di Capo Passero met pec van 18/4/2023 heeft gecommuniceerd dat "de stedenbouwkundige bestemmingen aangegeven in het C.D.U. van 27/10/2020 tot op heden onveranderd zijn").
Er wordt ook opgemerkt dat bij besluit van 17/4/2020, gecorrigeerd bij besluit van 8/5/2020, de gemeente Portopalo di Capo Passero de verlenging van de oorspronkelijke concessietitel met twintig maanden heeft bevolen vanaf de datum van overdracht van het onroerend goedcomplex.
