Deposit

The present gathering is subject to a mandatory deposit of 10% of price offered.

Deposit has to be paid in one of the following ways:

Participation Rules:

Participation in this sale is regulated by the conditions set out in the attached Sale Notice which the user is required to consult.


Lots Availability

Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.

Payment deadline

Payment of awarding price must take place on account indicated by the procedure within the time limit not exceeding 90 days from awarding.

Buyer's premium due (plus VAT) has to be paid within 20 days from awarding.

Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full  within 90 days from the provisional awarding.


Buyer's Premium

A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law). 
 
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.

For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above. 


VAT: 
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)


In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Italian language version of such texts

Les parcelles 1096 et 1120 - Feuille 42 feront l'objet d'un transfert à la commune de Portopalo di Capo Passero conformément aux conditions du plan de construction pour les travaux d'urbanisation.

Il est à noter qu'à l'examen du rapport, il est apparu que les terrains rustiques, adjacents et/ou faisant face au Plan de Construction Anime Sante ont une destination urbanistique prédominante "E" en partie résiduelle pour la circulation - les parkings où se trouvent diverses contraintes urbanistiques, dont, pour une partie des terrains, une limite de non constructibilité conformément à la L.R. 78/76 ; il est renvoyé au certificat de destination urbanistique délivré le 27/10/2021 (il est précisé qu'avec la pec du 18/4/2023, pour laquelle la commune de Portopalo di Capo Passero a communiqué par pec du 18/4/2023 que "les destinations urbanistiques indiquées dans le C.D.U. du 27/10/2020 à ce jour restent inchangées").

Il est également à noter qu'avec la décision du 17/4/2020, rectifiée par la décision du 8/5/2020, la commune de Portopalo di Capo Passero a prolongé, de vingt mois à compter du transfert du complexe immobilier, le titre concédé d' origine.
