The present auction is subject to a deposit of

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Poudarja se, da se nepremičnine prodajajo v celoti, saj je bil sklenjen predkupni pogodba z datumom 04/05/2022, redno vpisan, ki se nanaša na prenos v korist družbe, ki je že propadla - že lastnica polovice - ali tretjih oseb, ki bodo imenovane lastniki preostalega deleža zemljišč, ki se bo prenesel po dodelitvi.
Zazidljiva zemljišča v velikosti 12.425 m2 spadajo v gradbeno območje C3.2 Lu Gialdinu in spadajo v podobmočje C1.10 (člen 35 NTA Občinski prostorski načrt Santa Teresa Gallura) ter v vsakem primeru območje, ki je predmet parcelacije z omejitvami in urbanističnimi omejitvami, ki izhajajo iz uporabe referenčnega člena v podobmočju C1.10.
Kurator si pridržuje pravico, da sprejme in oceni ponudbe v znesku, ki je nižji od zgoraj navedene izhodiščne cene v mejah 25%.
Takšne ponudbe se bodo ocenjevale šele po koncu te dražbe po nedvomnem presoji organov postopka, izključno v primeru odsotnosti nepreklicnih ponudb v znesku, enakem ali višjem od izhodiščne cene.
Za oddajo ponudbe pod zgoraj navedenimi pogoji morebitni zainteresirani NE smejo slediti postopku "DOVRŠITVE PONUDBE NA IZHODIŠČNO CENO DRAŽBE", ampak morajo poslati zahtevo na naslov pec gorealbid@pec.it za informacije o načinu predstavitve in prejemanju ustrezne ponudbene obrazca.
V vsakem primeru bodo nepreklicne ponudbe za nakup, podane v skladu z zgoraj navedenimi pogoji, podvržene plačilu kupnine, poleg zakonskega DDV, kot je navedeno v splošnih in posebnih pogojih ter v priloženem obvestilu o prodaji.
