Deposit
The present auction is subject to a deposit of
EUR 40.000,00.

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
S'ha de destacar que els béns es posen a la venda en la seva totalitat, atès que s'ha subscrit un contracte preliminar de compravenda de data 04/05/2022, degudament transcrit, que té com a objecte la transferència a favor de la societat fallida - ja propietària de la quota de 1/2 - o a tercers a designar de la resta de la quota dels terrenys, que serà transferida després de l'adjudicació.
Els terrenys edificables de 12.425 m² es troben al sector edificatori anomenat C3.2 Lu Gialdinu i pertanyent a la subzona C1.10 (art. 35 NTA Pla Urbanístic Municipal de Santa Teresa Gallura) i, en tot cas, és una àrea sotmesa a parcel·lació amb els límits i les restriccions edificadores-urbanístiques que es deriven de l'aplicació de la norma de referència a la subzona C1.10.
El Curador es reserva la facultat de rebre i avaluar ofertes d'import inferior al preu base indicat en el límit del 25%.
Aquestes ofertes seran avaluades només després del termini de la present subhasta a insindicable judici dels Òrgans de la Procediment, únicament en absència d'ofertes irrevocables d'import igual o superior al preu base.
Per tal de formular una oferta en les condicions descrites, els possibles interessats NO hauran de seguir l'itinerari de "PERFECCIONAMENT DE LES OFERTES AL PREU BASE D'ASTA", sinó que hauran d'enviar una sol·licitud a l'adreça pec [email protected] per conèixer les modalitats de presentació i rebre el corresponent formulari d'oferta.
En tot cas, les ofertes irrevocables de compra presentades en base a les condicions esmentades seran sotmeses a l'aplicació del Buyer's Premium més IVA de llei, com s'indica en les condicions generals i específiques i en l'avís de venda adjunt.
