Deposit
The present auction is subject to a deposit of

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Se subliniază că bunurile sunt puse în vânzare în întregime, având în vedere că a fost încheiat un contract preliminar de vânzare-cumpărare la data de 04/05/2022, înregistrat în mod regulamentar, având ca obiect transferul în favoarea societății falimentate - deja proprietară a unei cote de 1/2 - sau a terților desemnați pentru cota rămasă a terenurilor, care va fi transferată după adjudecare.
Terenurile construibile de 12.425 mp cad în sectorul de construcții denumit C3.2 Lu Gialdinu și căzând în subzona C1.10 (art. 35 NTA Planul Urbanistic Comunal al Santa Teresa Gallura) și în orice caz zonă supusă lotizării cu limitele și constrângerile edilitar-urbanistice rezultate din aplicarea normei de referință la subzona C1.10.
Curatorul își rezervă dreptul de a primi și evalua oferte de sume mai mici decât prețul de pornire indicat în limita de 25%.
Astfel de oferte vor fi evaluate doar după încheierea acestei licitații la discreția organelor procedurale, exclusiv în lipsa unor oferte irevocabile de sume egale sau mai mari decât prețul de pornire.
Pentru a formula o ofertă în condițiile descrise mai sus, cei interesați NU trebuie să urmeze procedura de "PERFECTIONAREA OFERTELOR LA PREȚUL DE PORNIRE A LICITAȚIEI", ci vor trebui să trimită o solicitare la adresa pec gorealbid@pec.it pentru a afla modalitățile de prezentare și a primi formularul de ofertă corespunzător.
În orice caz, ofertele irevocabile de achiziție prezentate în conformitate cu condițiile menționate mai sus vor fi supuse aplicării Buyer's Premium plus TVA legală, așa cum este indicat în condițiile generale și specifice și în anunțul de vânzare atașat.
